FLB Law’s Appellate Practice is staffed with experienced attorneys who argue appeals before state and federal courts including the Connecticut Supreme Court, Connecticut Appellate Court, Federal Circuit Courts, and Mohegan Gaming Disputes Court of Appeals. FLB Law’s appellate attorneys partner with clients to overturn unfavorable decisions, defend positive outcomes, and when appropriate, prepare amicus curiae briefs when a third-party’s appeal affects their interests.

The FLB Law appellate team is comprised of Stephen Fogerty, Thomas Lambert, Brian Tims, Joshua Auxier, Robert Rhodes and Matthew Sportini as well as paralegals Christina Bennett and Kim Koorse. They handle appeals of matters of varied complexity and areas of law, including but not limited to tort and commercial litigation. Our deep bench of skilled attorneys understands that compelling and persuasive writing supported by relevant case law are key to a successful appeal. Strong oral advocacy and an understanding of the technical procedures unique to appellate practice are also cornerstones of positive outcomes. As with all engagements, our attorneys zealously advocate on behalf of our clients and work to resolve cases with solutions aligned with their goals.

Our clients will be looking for that passionate advocacy as we continue to emerge from the pandemic. “We expect to see appeals of COVID-related matters, such as business interruption cases, employment matters and personal injury matters,” shared Joshua. “There is little to no precedent on numerous issues being litigated in state and federal court, and some judges are making decisions based on existing, but inadequate, precedent. We stand ready to assist our clients with their appeals or, when necessary, prepare amicus curiae briefs when a third-party’s appeal affects their interests.”

Regarding COVID-related appeals in the real estate and development sector, Eric Bernheim expects to see appeals of landlord-tenant disputes related to force majeure and cases involving nonpayment of rent, evictions, foreclosures, and bankruptcy rulings.
