Practice Spotlight: Employment Law

FLB’s Employment Law practice represents businesses across all industry sectors, helping them manage and navigate the dynamic legal and regulatory landscape of labor and employment law. Our team of attorneys includes Thomas Lambert, Stephen Fogerty, Joshua Auxier, Robert Rhodes, Brian Tims and Matthias Sportini as well as legal assistant Christina Bennett.

Our attorneys provide advice and counsel on best practices that support strong business operations. We work with senior management and human resource executives to create policies and procedures that help mitigate litigation, such as reviewing and drafting employee handbooks, employment and termination agreements, and severance packages. We also audit and develop our clients’ sensitivity training programs and ensure compliance with the American Disabilities Act (ADA), the Fair Labor Standards Act (FLSA), and other federal and state labor laws. 

If litigation arises, our experienced team resolves matters as efficiently and cost effectively as possible. Typical claims include age discrimination and violations of FLSA, ADA, Family Leave Act, and others. There is no one-size-fits-all solution; we create outcomes that meet our clients’ individual short- and long-term goals.

The COVID-19 pandemic has created a long list of compliance issues for businesses of all kinds. According to Tom, these include enforceability of restrictive covenants, what constitutes reasonable geographic noncompete restrictions for a remote workforce, and a slew of other issues including compliance with OSHA, CDC, and other agency guidelines related to returning to work, employer vaccine requirements, sick leave requirements, and many others. COVID-19 has opened up Pandora’s Box for employers, who need to navigate these choppy waters with practical and informative counsel.
